By downloading, installing, or using the based takes mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

based takes is a mobile application that allows users to view and vote on cultural content and trends. Users can swipe through content and indicate their preferences by voting "Fire" or "Fade" on various cultural moments and topics.

3. Account Types

Anonymous Usage: You may use the App without creating an account. Anonymous usage stores your votes, points, and achievements locally on your device only.

Registered Accounts: You may optionally create an account by providing your email address and selecting an age range. Registered accounts save your voting history, points, and achievements to our servers, allowing you to access your data across devices and sessions.

4. Eligibility

You must be at least 13 years old to use this App. Users under 18 must have parental consent. By using the App, you represent that you meet these age requirements.

5. User Conduct

You agree to use the App in accordance with all applicable laws and regulations. You will not:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems to interact with the App
• Interfere with or disrupt the App's functionality
• Engage in any activity that could harm or impair the App's operation

6. Content and Voting

The App displays cultural content for user voting. All content is provided for entertainment purposes. Voting data may be aggregated and displayed within the App. You understand that your votes contribute to collective statistics shown to other users.

7. Intellectual Property

The App, including its design, functionality, text, graphics, and other content, is owned by based takes and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes only.

Data We Collect (for registered accounts only):

• Age range (one of four broad categories: 18-25, 25-40, 41-55, or 55+)

Data We Do NOT Collect: We do not collect your name, specific age, date of birth, gender, location, or any other personal identifying information beyond email and broad age range.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination of a registered account, your data may be deleted from our servers in accordance with our Privacy Policy and data retention practices.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the App constitutes acceptance of modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
